The Offinso Traditional Area in the Ashanti Region is embroiled in a contentious legal battle following the enstoolment of a new Offinsohene, Nana Kwaku Amoako Poku, also known as Nana Dwamena Akenten II.
The Paramount Queen Mother of Offinso, Nana Ama Serwaa Nyarko, has filed a petition with the Judicial Committee of the Ashanti Regional House of Chiefs, seeking to nullify the installation of Nana Amoako Poku, which she claims was carried out in violation of traditional and statutory procedures.
According to the petition, Nana Ama Serwaa Nyarko asserts that she did not nominate Nana Amoako Poku for the Offinso Stool, as required by custom.
Instead, she had nominated Dr. Kofi Koduah Sarpong, who was reportedly confirmed by the Kingmakers of Offinso.
“The enstoolment of Nana Amoako Poku is a clear breach of the established customs of our community,” the writ stated, arguing that the 1st Respondent’s enstoolment was uncustomary and thus, a nullity.
The Queen Mother further alleges that the enstoolment was executed under the protection of heavily armed military personnel, an act she describes as unprecedented and unlawful.
“The Offinso Palace was besieged by a combined police and military team, creating an atmosphere of intimidation and forcing through an enstoolment that lacks legitimacy”.
This action, she argues, undermines the traditional authority and processes that have governed the chieftaincy for generations.
In her plea, Nana Ama Serwaa Nyarko is requesting that the Judicial Committee issue a perpetual injunction to restrain Nana Amoako Poku from performing any duties as Offinsohene.
Additionally, she seeks a declaration affirming the rightful nomination and election of Dr. Kofi Koduah Sarpong as the legitimate heir to the Offinso Stool.
“We are not just fighting for a title; we are defending the integrity of our traditions and the rightful processes that must be followed.”
The outcome of this legal dispute is likely to have significant implications for the Offinso Traditional Area, as it not only challenges the authority of the newly installed chief but also raises broader questions about the adherence to customary law in the enstoolment of chiefs.
