Legal battle far from over as NDC eyes review after Kpandai ruling

The National Democratic Congress (NDC) has insisted that the Supreme Court’s decision to reinstate the New Patriotic Party’s (NPP) Member of Parliament for Kpandai, Matthew Nyindam, does not bring closure to the legal battle surrounding the constituency’s 2024 parliamentary election.

His comment comes after the apex court, in a 4–1 majority decision, quashed the Tamale High Court’s judgment that had annulled Mr Nyindam’s election, citing jurisdictional error.

The apex court upheld an application filed by Mr Nyindam invoking its supervisory jurisdiction to set aside the High Court ruling, thereby restoring his mandate as Member of Parliament for Kpandai.

Speaking to journalists after the ruling on Wednesday, Majority Chief Whip in Parliament and NDC MP for South Dayi, Nelson-Rockson Deafeamekpor, said the party was “grieved” by the outcome but emphasised that constitutional and legal options remain open.

“This is not the end. This matter is not the end. The ruling of the court will be filed according to the court’s own decision by February 6.

When we obtain the certified true copy and study it, we will advise ourselves. There is a review option, so this matter is not the end,” he maintained.

He urged party supporters, both in Accra and in the Kpandai constituency, to remain calm and law-abiding as the party evaluates its next course of action.

However, the Director of Legal Affairs of the NPP, Gary Nimako Marfo, has described the Supreme Court’s decision as clear, emphatic and final.

According to Mr Nimako Marfo, the ruling leaves no ambiguity regarding the legal position, explaining that the Tamale High Court judgment was lawfully quashed, thereby maintaining Mr Nyindam’s status as the duly elected Member of Parliament for the Kpandai constituency.
